DUI in Augusta / License & ALS

Georgia DUI license suspensions and ALS hearings

A court notice and a DDS notice serve different purposes. Bring both. The first task is to identify the exact administrative action, how notice was given, and what response is available in your circumstances.

Criminal defense and administrative license guidance.

The statutory hearing request

For a hearing under O.C.G.A. § 40-5-67.1(g), the written request and required $150 fee must be submitted within 30 days of personal notice or receipt of notice by certified mail or statutory overnight delivery. Missing the deadline can waive that hearing. Different notice procedures can apply, including regular-mail DDS notices. Bring every notice and its envelope promptly so the applicable response can be checked.

Choosing a response requires care

A hearing request and an ignition-interlock permit, where available, have different requirements and consequences. Obtaining an ignition-interlock permit under this ALS process waives the administrative hearing. Some interlock obligations can continue even after an acquittal or other nonconviction. I review the choices and consequences that apply to your circumstances.

Bring the whole notice

  • DDS notices, including Form 1205 or 1205-S, with their envelopes.
  • Your citation, temporary permit, bond papers, and court notices.
  • Information about prior DUI matters and any commercial or out-of-state license.

Driving permission is a separate question

Do not assume that scheduling a consultation, having a pending case, or submitting paperwork by itself authorizes driving. Call my office promptly to discuss the notice and your circumstances.
